Acceptable Use Policy & Code of Conduct

This Acceptable Use Policy (“AUP”) and Code of Conduct (collectively, the “Policy”) governs your use of Leadnest.ai’s services, websites, applications, and APIs (“Services”). By accessing or using our Services, you agree to comply with this Policy.

Our goal is simple: to ensure Leadnest.ai is used responsibly, lawfully, and in a way that builds trust between businesses and their audiences.

Guiding Principles

Leadnest.ai is built on three foundations:

  • Consent First: Messages must only be sent to individuals who have knowingly and explicitly opted in.
  • Respect Always: No harassment, discrimination, exploitation, or misleading behavior.
  • Compliance Everywhere: You must follow all applicable laws and industry standards, including CTIA, TCPA, 10DLC (U.S.), GDPR (EU), DPDPA (India), HIPAA (U.S.), CAN-SPAM (U.S.), CASL (Canada), and any other relevant regulations.

Violations may result in suspension, restriction, or permanent termination of your access.

Permitted Uses

You may use Leadnest.ai to:

  • Send communications (push, email, SMS, MMS, WhatsApp, voice, web, or IoT) only to recipients who have provided valid, auditable consent.

  • Manage leads and customer data with proper legal authority.
  • Analyze engagement, campaign performance, and customer journeys for legitimate business purposes.
  • Integrate Leadnest.ai APIs into your applications, provided the integration complies with this Policy and all applicable data protection laws.

Prohibited Content

You may not use Leadnest.ai to create, store, or transmit content that:

  • Is unlawful or illegal: Fraud, phishing, scams, criminal solicitation.
  • Violates rights: Intellectual property, privacy, data protection, publicity rights.
  • Is harmful or exploitative: Child sexual abuse material (CSAM), human trafficking, terrorism, self-harm, violence.
  • Is discriminatory or hateful: Based on race, religion, gender, sexual orientation, disability, or protected class.
  • Is misleading or manipulative: False advertising, deceptive subject lines, “dark patterns.”
  • Violates healthcare protections: PHI may only be transmitted if you are on a HIPAA-compliant plan with a signed BAA.
  • Violates carrier rules: SHADE content (sexually explicit, hate, alcohol, drugs, gambling) or other restricted 10DLC categories leadnest_sms_compliance_changes

Prohibited Conduct

You must not:

  • Send Spam: Unsolicited bulk messages, cold outreach without consent, or excessive frequency.
  • Ignore Opt-Outs: You must honor STOP, DND, or unsubscribe requests immediately across all channels.
  • Bypass Controls: Attempt to circumvent rate limits, suppression lists, or deliverability safeguards.
  • Exploit or Attack the Platform: Abuse APIs, brute force logins, inject malicious code, or overload infrastructure.
  • Reverse Engineer or Scrape: Decompile, extract, or harvest platform data or AI outputs.
  • Resell or Misuse Accounts: Share credentials, impersonate others, or resell access without authorization.

Data & Compliance Obligations

  • Consent Management: Maintain verifiable consent records (IP, timestamp) for all contacts.
  • Transparency: Maintain a public-facing Privacy Policy describing data use, sharing, and opt-out rights.
  • Opt-Out Support: Clearly display “Reply STOP to unsubscribe” and “Reply HELP for assistance” in messages where required leadnest_sms_compliance_changes.
  • Sensitive Data: Process health, biometric, or financial data only under explicit consent and secure handling.
  • Cross-Border Transfers: Ensure lawful transfer (e.g., SCCs for EU).
  • Regulatory Compliance: You are responsible for compliance with sectoral rules (HIPAA, PCI-DSS, FINRA, etc.).

Enforcement & Remedies

Leadnest.ai enforces this Policy firmly but fairly:

  • Notice & Remediation: For minor violations, we’ll notify you to correct issues.
  • Suspension: For repeated or serious violations, your account may be temporarily suspended.
  • Termination: Egregious, fraudulent, or malicious use will result in permanent account closure.
  • Legal Action: We may seek damages, cooperate with law enforcement, and notify regulators.

Code of Conduct (Community & Engagement Spaces)

When using Leadnest.ai support channels, forums, or events:

  • Treat others with respect. Harassment or bullying will not be tolerated.
  • Contribute constructively. No spam, trolling, or disruptive behavior.
  • Follow moderator instructions.
  • Protect confidentiality. Do not share private data without consent.

Reporting Violations

Report violations to abuse@leadnest.ai. All reports are reviewed promptly and confidentially.
